ARBITRABILITY OF PUBLIC SECTOR GRIEVANCES AFTER EXPIRATION OF A CONTRACT

Abstract

This article reviews public employers' obligations to arbitrate grievances after contracts expire. Decisions refusing to extend arbitration into contract hiatus periods are contrasted with those permitting arbitration of grievances arising during a contract's life but coming to arbitration after expiration of that contract. This examination should assist public employers in drafting grievance arbitration provisions limiting the arbitration obligations when contracts expire.
